2010-02-11 82 0 Endorsed Letter ENDORSED LETTER addressed to Judge Richard M. Berman from Jennifer Rossan dated 1/22/2010 re: I am an Assistant Corporation Counsel in the Office of the Corporation Counsel and one of the attorneys for defendants in the above-referenced matter. On December 3, 2009, the Court issued an order addressing the production of documents that plaintiffs deem to be confidential. These documents are those that defendants seek to obtain via authorizations executed by plaintiffs, and include, inter alia, medical records, mental health records, employment records and educational records. The parties have been negotiating the terms of a proposed Stipulation and Order for the Production and Exchange of Confidential Information ("Stipulation") with respect to the records at issue. While the parties were able to agree on much of the language in the Stipulation, despite best efforts, there are certain provisions of the Stipulation upon which the parties cannot agree. These disputed issues are set forth below and the disputed provisions are highlighted in the proposed Stipulation that will be submitted by plaintiffs' counsel. Therefore, defendants respectfully request that the Court deny plaintiffs' request that the records be designated for "attorneys' eyes only.". ENDORSEMENT: SO ORDERED. (Signed by Judge Deborah A. Batts on 2/11/2010) (jmi) (Entered: 02/11/2010)

We have, in the past, entered into numerous stipulations with the Law Department with similar provisions and we have, in the past, carried out the destruction and/or return of documents in accordance with the tenns of those provisions. 2010-12-22 118 0 Endorsed Letter ENDORSED LETTER addressed to Magistrate Judge Ronald L. Ellis from Myron Beldock, dated 12/22/2010, re: We write on behalf of all plaintiffs to request an extension of time to complete and serve the charts of damages for the familial plaintiffs. At the November 24, 2010 conference Your Honor directed that authorizations and the charts be served by a date to be designated by plaintiffs' counsel. The date selected was December 17th. However, for various reasons, plaintiffs' counsel have been unable to complete the work required for the charts and therefore request an extension of time to do so until January 5, 2011. Our ability to complete the required work has been impaired in part by respiratory illnesses for several counsel in our office and by various burdens, including our having timely served well over 100 familial authorizations - with the exception of authorizations for one plaintiff who is currently undergoing chemotherapy, as to whom there has been an agreed delay. We have discussed this request for an extension of time with Assistant Corporation Counsel Elizabeth Daitz, Esq. She has asked that we make this written request to the Court and that we provide her with the charts in advance of the court conference on January 6th. We expect that the charts for some of the familial plaintiffs, including at least the Salaam plaintiffs, will be provided by year end and that all others will be provided by no later than January 5, 2011. ENDORSEMENT: SO ORDERED. (Signed by Magistrate Judge Ronald L. Ellis on 12/22/2010) (lnl) (Entered: 12/22/2010)

2013-03-05 218 0 Letter addressed to Magistrate Judge Ronald L. Ellis from Philip R. DePaul dated 2/20/2013 re: Defense counsel writes regarding the Court's Opinion and Order dated February 19,2013, in which the Court granted Florentine Films' motion to quash defendants' subpoena. Specifically, defendants write regarding the Court's statement that defendants manipulated a quote attributed to Ken Burns in Variety magazine, Defendants did not manipulate that quote, as indicated on pages 910 of the Opinion, and respectfully request that the Court modify its Opinion and Order accordingly. Document filed by The City of New York.(ago) (Entered: 03/05/2013)
2013-03-05 219 0 MEMORANDUM OPINION AND ORDER: #102970 The City asserts that the quotes, taken together or separately, are not misleading. (Feb. 20,2013 Letter from Philip DePaul to Court, at 3.) The Court disagrees. Together the quotes show that they were taken in the context of promotion for the documentary at a film festival. It shows that the persons reporting on the words of the filmmaker did some editing of their own so that it is not possible to know what was left out. As the Court suggested in its opinion, the quoted portions containing ellipses are not reliable. Further editing to indicate otherwise is misleading. SO ORDERED. (Signed by Magistrate Judge Ronald L. Ellis on 3/05/2013) (ama) Modified on 3/7/2013 (jab). (Entered: 03/05/2013)

2013-09-26 248 0 ORDER: Before the Court is Defendants' application to limit the questioning of Ruby Marin Jordan's testimony to the time period leading up to and including the publication of the Armstrong Report ("the Report"). The Court has reviewed Defendants' September 23, 2013 letter, and Plaintiffs' September 24, 2013 letter, and DENIES the application.Defendants assert that Marin-Jordan's activities after the issuance of the Report implicate the attorney-client privilege or the work product doctrine. They have failed to support this claim. To the extent there was any investigation after the Report, the availability of privilege would depend on the nature of the investigation and Marin-Jordan's role in it.Also, Defendants seek to limit the temporal scope of the deposition by claiming that no relevant information can be obtained through inquiries from the challenged time period. However, knowledge gained after an event may lead to relevant evidence about the event. Discovery indeed is premised on this assumption. In the absence of more specificity concerning any purported investigation, prior temporal limitation is not sustained. (Signed by Magistrate Judge Ronald L. Ellis on 9/26/2013) (js) Modified on 9/26/2013 (js). (Entered: 09/26/2013)
